Framework before product

3a or 3b: establish the framework before discussing returns

Pillar 3a is tied private pension provision subject to legal conditions, whereas 3b covers a broader range of unrestricted provision. Correct labelling prevents 3a restrictions or benefits from being attributed to every savings product. Your status and the precise form must be checked before a payment is treated as deductible.

Distinctions that change the analysis

Tied provision

Pillar 3a uses recognised forms and its assets are not freely available at all times. The FSIO describes the general entry conditions; the FTA, tax authority and institution apply them to the period and facts.

Unrestricted provision

Pillar 3b may include savings, investments or life insurance and is not one homogeneous product class. Liquidity, taxation, risk and guarantees come from the chosen form and contract.

Recognition to check

For 3a, check the institution and recognised form against FTA sources. Inclusion confirms a defined tax-recognition point; it does not compare charges, risk, service or suitability.

Questions before a contribution

These checks prepare a confirmation request; they do not decide eligibility.

  1. Which income and insurance status?

Describe the type of work, OASI link, any unemployment daily allowance and cross-border features for the institution or authority to assess.

  2. Which legal form?

Ask whether you are entering an agreement with a bank foundation, an insurance policy or unrestricted provision outside 3a, and obtain the document proving it.

  3. Which rule is current?

Open the FTA page for the relevant period and have the limit, deduction and any catch-up mechanism confirmed rather than reusing an older figure.

  4. Keep the verified conclusion

Record the date, source, institution’s reply and contract version so that the point can be checked again before a later decision.

Shortcuts to avoid

  • A product using the word pension is not automatically a recognised pillar 3a form.
  • A published federal deduction does not by itself determine your total or cantonal tax outcome.
  • This article does not certify your right to contribute, make a catch-up payment or deduct a particular contribution.

Verified Swiss federal sources

Verified English guidance is linked where the FSIO, FTA and FINMA provide it. The current contribution-limit page and the controlling OPP 3 and Insurance Contract Act texts fall back to French because no equivalent current English legal source was verified. German, French and Italian official texts, the competent authority and the provider’s documents remain decisive.
