Separate cost items and mechanisms
Court and party costs
The Code separates court expenditure from compensation owed to another party. A policy may treat them differently, and final costs are not the same as an initial advance.
Advance and allocation
Article 98 contains a general rule and exceptions; the unsuccessful party generally bears costs subject to the applicable rules. Never promise a fixed half or no fees.
Civil legal aid
It notably requires insufficient means and a case that does not appear devoid of prospects. It may be partial and does not automatically remove adverse party-cost exposure.
Insurance cover
Fees, experts, advances and costs are met only under the clauses, limits, deductible and prior-approval rules.
Prepare the cost picture without inventing a figure
Ask the court, representative, insurer and legal-aid authority separately about their own part.
Identify the procedure
Establish the authority, canton, procedure type and amount in dispute before interpreting a tariff or advance rule.
Split the costs
Separate your lawyer, court, evidence, translation, experts, advances and possible adverse party costs.
Check both mechanisms
Ask the insurer for its contractual position and the authority for legal-aid requirements; one does not prove the other.
Protect every deadline
Keep dated documents and replies. A comparison request, complaint, mediation request or FINMA report does not automatically stop a statutory, court or contractual deadline.
No automatic cost estimate
- This page calculates no lawyer fee, court cost or prospect of success.
- Legal aid is not automatic; the competent authority decides on the application.
- Relief from advances or court costs does not necessarily remove adverse party costs.
- Requests to insurers or authorities do not themselves stop deadlines.
